General

Our aim is to provide you with a service that is both educational and fun. However, there are some terms and conditions ("Terms") below that apply to your use of the O2 Learn BETA service (the "Service") - please read them carefully.

In these Terms, any reference to "we" "us", "our" or "O2" means Telefónica UK Limited, a company registered in England (Company Number 01906156) and any reference to "you" or "your" refers to you, the user of the Service, whether you use it as a student or a teacher.

By accessing, registering for or using the Service, you confirm that you agree to be bound by these Terms. You also confirm that you are a UK resident and if you wish to register to use the Service that you are at least 13 years old.

We are always trying to improve the Service and so its content and the way it looks may change without prior notice to you. In addition, we may stop (permanently or temporarily) providing the Service (or any particular features in it) to you or to users generally and might not provide you with prior notice. We hope that you will be happy with the way that the Service works but if not please provide us with your feedback, which we will take on board.

Description of Service

The Service allows teachers to upload videos showing themselves or others giving lessons on a particular part of the national curriculum for students aged between 13-18 years old ("Videos"). Students can search for and view any hosted Videos and provide ratings and comments (referred to below as "Contributions") on them, and can suggest that teachers create and upload Videos on particular topics. Students can also upload videos with their teacher's permission.

Teachers and students may upload, and students may view, as many Videos as you wish and it's all free.

All you need to use the Service is a computer, an O2 Learn account and (if you wish to upload Videos) a recording device. You don't even need to be on O2 to use or register for the Service.

Privacy policy and data protection consent

Information that you provide as part of registering for the Service and any other information that you may provide to us falls within the O2 Privacy Policy. The current version of that policy forms part of these Terms and can be viewed here:

Public BETA

You understand that the Service is provided as a BETA service, meaning that it is experimental and is provided "AS IS" to allow us to obtain your feedback on the way the Service works. The Service may contain errors or inaccuracies that could cause failures, corruption or loss of Videos and/or Contributions (together "Content) from the Service's website. You confirm that you accept all risks and all costs associated with your use of the Service, including but not limited to any damage to, loss or accidental publication of any information or data, including any Content you submit. In addition, you acknowledge that we are under no obligation to provide any maintenance, technical or other support for the Service.

You sharing Content with us

We do not claim to own any Content you submit to the Service and you will keep all rights in your Content, which means that you can use it in any way, including allowing others to use it. However, by sharing your Content with us, you also give us your unrestricted permission to use your Content, free of charge, for the operation and promotion of the Service.

So that we can use your Content, you confirm that it is your own original work (or that you have the consent of anyone whose work is included in your Content), is not defamatory, does not break any UK laws, that you have the right to give us permission to use it, and that you have the written consent of anyone who is identifiable in your Videos(s) (or the consent of their parent/guardian if they are under 16). Teachers should note that any applicable copyright licences (such as CLA or ERA licences) may not apply outside of their school.

If you're under 16, please get a parent or guardian's permission before sharing any Contributions with us.

Use of Content by us

You agree that we may keep hold of your Content and use it for the operation and promotion of the Service, without further compensation to you. We may also make changes to your Content for operational or editorial reasons.

O2 and users sharing Content with third parties

You agree that we may share your Content with trusted third parties, who will then have the same rights as us to use your Content and to do so without providing any compensation to you.

Also, the Service will allow other users to share your Content on other popular websites, such as YouTube. By uploading your Content onto the Service, you confirm that you are happy with this.

Your conduct

You accept that you are responsible for your use of the Service, for any Content you provide, and for any consequences of your use or posting of Content; this includes any consequences arising from the use of your Content by other users or our third party partners. You are also responsible for any use or Content posted in the name of your account, whether this use or posting was authorised by you or not.

You will:

  • use the Service only for lawful purposes, for your own personal, non-commercial use and not in any way that affects other users' use and enjoyment of the Service;
  • not use multiple log-ins for disruptive purposes or in a way calculated to annoy others;
  • not, without our consent or the consent of the person(s) providing the Content (as appropriate), sell, copy or incorporate into any other work, part or all of the Content or any other material available through the Service save that you may print or download extracts of the material for your personal use only;
  • not store, modify, transmit, distribute, broadcast or publish any part of the Content without our consent or the consent of the person(s) providing the Content;
  • comply fully with any additional conditions displayed relating to particular Content or particular aspects of the Service and comply with any other instructions issued by us regarding use of the Service and Content; and/or
  • not, without our written consent, save as permitted by law:
    1. copy, modify, disassemble, reverse engineer, decompile or in any other way interfere with any software provided as part of the Service; or
    2. create any new software partly or wholly based on the software; or
    3. transfer, assign or sub-license your right to use the software or attempt to do so; or
    4. purport to permit any other person to do anything prohibited by a. to c. above.
Your Content

Your Content (including your user name) must be civil and tasteful and in particular:

  • must not be unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented(save where genuine educational purposes dictate that this is the case, for example, in relation to Biology videos having reproduction as their subject matter), racially offensive or otherwise objectionable;
  • must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble;
  • should not contain any advertising or promoting material, including the posting of links to other websites (save where such postings are included for genuine educational purposes, which will generally be limited to links to media, government or academic websites);
  • should not contain any personal information, including your full name, school, home address, phone number or email address;
  • should be contributed in the appropriate place. Please only submit your Videos under the relevant subject category and make sure your Contributions are relevant to the place you are posting them in;
  • should not be in any language other than English, save for where a topic requires use of a foreign language for instructional purposes; and
  • should not contain impersonation of any person.

If your Content breaks any of these rules, we may delete that Content and take action against your account. If you continue to break these rules and/or you break any of them in a serious manner, we may use whatever information we have about you to prevent any further infringements, including contacting your school or employer.

Moderation of Content

We are using an external moderation agency to keep an eye on this site. Here's how they will check Content uploaded to the site:

  • Videos will be watched BEFORE they go live on the site to check that they:
    • are not abusive;
    • are not vulgar or inappropriate;
    • contain no unlawful material;
    • contain no impersonation;
    • contain no personal information; and
    • are not advertising or selling anything.
  • Contributions to the site will be reviewed twice daily AFTER they have been posted to check that they satisfy the criteria above and in addition that they are not comments of a personal or bullying nature directed at the teachers in the Videos or any other individuals (whether in the Videos or not).

Further, we moderate our video lessons for accuracy through our O2 Learn (Learning Champions). They're qualified teachers and are specialists in the subjects they moderate for us.

We're working with The Schools Network (Formerly The Specialist Schools and Academies Trust), which is coordinating a group of qualified teachers in specialist subjects to check the lessons for accuracy. We call them the Learning Champions. Each lesson that's watched by a Learning Champion is marked. They're given an Approve Video icon if they're entirely accurate or an Approve Video but with Issues icon if they're largely accurate but have added constructive comments (designed to help students). If a lesson's not accurate we'll contact the teacher about amending the video or removing it altogether. Please email support if you have any questions.

Removal of Content

You can ask us to remove any Film by using the "Report" link underneath the Film or by sending an email to
support@o2learn.co.uk

You can ask us to remove any Contribution made to the Service by sending an email to
support@o2learn.co.uk

If any of your Content breaks the rules in these Terms, we may have to remove that Content from the Service without advance warning.

Termination of Service

We may temporarily or permanently stop providing the Service (or any particular features in it) to you or to users generally at any time and might not provide you with prior notice.

You can close your user account at any time by clicking the "Close my account" button at the bottom of your profile page.

Limitation of liability and exclusions

As set out above, all Content posted on the Service is created and/or uploaded by you and other users. You accept that you are responsible for your use of the Service, for any Content you provide, and for any consequences of your use and posting of Content; this includes any consequences arising from the use of your Content by other users or our third party partners. You are also responsible for any use or Content posted in the name of your account, whether this use or posting was authorised by you or not.

We are not responsible for any Content (including any errors, omissions or inaccuracies in the Content) posted on the Service or for any content available on third party sites that are accessible through the Service. Any links to third party sites from the Service do not amount to an endorsement of those sites by us. You accept that you use the Service and rely on any Content or content available on third party sites accessible through the Service at your own risk. As far as permitted by law, we exclude all representations and warranties regarding the Service and Content.

As also set out above, you understand that the Service is provided as a BETA Service and may contain errors or inaccuracies that could cause failures, corruption or loss of Content from the Service's website. You confirm that you accept all risks and all costs associated with your use of the Service, including but not limited to any damage to, loss or accidental publication of any information or data, including any Content you submit.

You accept that we do not guarantee that the Service website or the server that makes it available are free of viruses or bugs and that it is your responsibility to make sure that you have whatever anti-virus and other security checks you consider appropriate in place.

We do not accept liability in contract, tort (including negligence) or otherwise for direct or indirect loss of profits, income, business or anticipated savings, nor for any indirect, incidental or consequential damages, including, without limitation, loss or destruction of data or other information unless such losses were reasonably foreseeable to both of us at the relevant time when you used the Service.

We accept liability for death or personal injury caused by our negligence, as well as any other liability that can't be excluded or limited by law and this section does not apply to those types of liability.

Each part of the Terms excluding or limiting our liability operates separately. This means that if a court rules that any of those parts is unreasonable or inapplicable, the other parts still apply.

Indemnity

You must indemnify us against any losses, damages, expenses, claims or legal proceedings which are suffered by us or brought or threatened against us as a result of:

  • your use of the Service in a way that breaks the rules or warranties set out in these Terms; and
  • your use of the Service in a way that infringes any intellectual property rights.

We will let you know if there is any reason for us to think that we may need to take action under this section because of your use of the Service.

Waiver and severability

Just because we delay in taking action or do not take any action at all when you have broken the rules contained in these Terms does not mean that we cannot take action in respect of your breach in the future.

If any part of these Terms is invalid under any law, rule, order or regulation of any government, or is ruled to be invalid by any court, the remaining terms shall continue to apply.

Governing law

The Terms are governed by English law. Both we and you submit to the exclusive jurisdiction of the English courts.

Mobile broadband gift

To thank teachers and students for their efforts, we will send a mobile broadband starter pack to every teacher and student who uploads a lesson to O2 Learn, to help them, or one of their students get online. For students the mobile broadband starter pack will be awarded to their school for use or distribution as the school sees fit.

Each package includes unlimited access to thousands of Wi-Fi hotspots and 1Gb data access pre-loaded. This enables teachers to get online when out of the classroom. And helps students who don’t have access broadband at home get online also.

This isn’t good for downloading big files or playing games, but is perfect to get online to continue research, check emails and update collaborative wikis.

Those teachers who upload more than one lesson, will receive an additional Sim with 1Gb data access pre-loaded and free access to Wi-Fi hotspots for every additional lesson uploaded.

O2 Mobile Broadband Pay & Go: Subject to status. Mobile broadband. Access will last for the specified duration (daily or monthly) or until the specified data allowance is reached only, whichever is sooner. An equipment charge may apply. This promotion gift applies to the first 4,000 video lessons uploaded between 30th January 2012 – 12th November 2012.



  • Award Dates:

    Weekly: Week commencing 30th January 2012 – week commencing 5th November 2012. Entry is open 12 midnight GMT on Monday of each week to 23.59 GMT on Sunday each week (Closing Date). Please note that the number of views per video lesson is recorded at 23.59 on the Sunday after the Closing Date.

    (Together, the "weekly award")

    Annual: Following completion of the last weekly award, the winners of all previous weekly award will be invited to enter the Annual Promotion. The Annual Award will be judged based on the Judging Criteria and Judging Dates set out below.

  • Entry:

    Entrants must be:

    • O2 Learn registered teachers aged 18 or over and they must meet the Eligibility Criteria set out on the O2 Learn website; or
    • O2 Learn registered students of such identified O2 Learn registered teachers.

    To enter the weekly awards an eligible teacher must upload a lesson summary video to the O2 Learn site and opt into the award, and a student must upload a video lesson to the O2 Learn site and opt into the award, confirm they have the permission of their teacher, and name their teacher.

    Each weekly award winner will be the teacher(s) and their school(s) or the students(s) and their school(s) who loaded the highest rated (by registered O2 Learn users), most viewed (by O2 Learn registered users) video. Videos must be original. They must not have been previously uploaded in identical or substantially similar (to be determined at O2's absolute discretion) form.

    Entry to the Annual Award will be the Weekly Award winners and by invitation only.

  • Judging Criteria and Judging Date:

    The videos of the Weekly Award winners (the "Finalists") will be viewed by an expert education and industry panel (the "Panel", details of members will be available on request before judging) and a shortlist of 8 entries will be entered into a Grand Final (the "Grand Finalists").

    The Finalists films will be judged on the following criteria:

    * Connects with students, and makes learning exciting;
    * Communicates clearly;
    * Maintains factual accuracy;
    * Shares their enthusiasm for their subject, and brings the subject to life

    The Grand Finalists will be judged 50% by popular votes and 50% by the Panel.

    The 1st, 2nd, 3rd prizes in the Annual Promotion will be judged on the following criteria:

    * Connects with students, and makes learning exciting;
    * Communicates clearly;
    * Maintains factual accuracy;
    * Shares their enthusiasm for their subject, and brings the subject to life;
    * Makes a positive difference to their school;
    * Holds themselves and their students to the highest standards.

    Grand Finalist selection dates are:
    * Expert panel vote: 29th November 2012
    * Public vote: 12 Midnight [GMT] 3rd September 2012 – 12 midnight [GMT] on 19th December 2012

    The final prize winners will be notified and announced 21st December 2012.

  • Prizes:

    Weekly Awards:

    • If a teacher(s) video wins, £1000 to the teacher(s) registered as making and uploading the video, and £1000 to their department at their school; or
    • If a student(s) video wins, £1000 to the school of the student(s) registered as making and uploading the video and £1000 to their school that the student has a say in spending e.g. a class trip.

    Annual Award 1st prize:

    • If a teacher(s) video wins, £15,000 to the teacher(s), registered as making and uploading the video, and £30,000 to their school (to be spent on a major project to be approved by O2, like building work or improving computing, and cannot be used for the school's running costs); or.
    • If a student(s) video wins, £15,000 to the school of the student(s) registered as making and uploading the video that the student has a say in spending e.g. a class trip, and £30,000 for their school (to be spent on a major project to be approved by O2, like building work or improving computing, and cannot be used for the school's running costs).

    Annual Award 2nd Prize

    • If a teacher(s) video wins, £7,500 to the teacher(s) registered as making and uploading the video, and £15,000 to their school (to be spent on a major project to be approved by O2, like building work or improving computing, and cannot be used for the school's running costs); or
    • If a student(s) video wins, £7,500 to the school of the student(s) registered as making and uploading the video that the student has a say in spending e.g. a class trip, and £15,000 for their school (to be spent on a major project to be approved by O2, like building work or improving computing, and cannot be used for the school's running costs).

    Annual Award 3rd prize

    • If a teacher(s) video wins £4,000 to the teacher(s) registered as making and uploading the video, and £8,000 to their school (to be spent on a major project to be approved by O2, like building work or improving computing, and cannot be used for the school's running costs); or
    • If a student(s) video wins, £4,000 to the school of the student(s) registered as making and uploading the video that the student has a say in spending e.g. a class trip, and £8,000 for their school (to be spent on a major project to be approved by O2, like building work or improving computing, and cannot be used for the school's running costs).

    Prizes will be provided by cheque to the teacher or school.

  1. These Promotions are open to all O2 Learn registered teachers and their registered students opting into the award, excluding employees of O2, or any of its subsidiary companies, agents or anyone else connected with this promotion. No third party entries, or entries submitted by agents will be accepted. O2 reserves the right to verify the eligibility of entrants. O2 may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and the prize may be withheld until and unless O2 is satisfied with the verification.
  2. Entries not complying with terms and conditions will be invalid. Each eligible teacher may only win a maximum of two of the Weekly Promotions and/or one Annual Promotion prize (including films in which they feature with other eligible teachers.
  3. The Promotions run during the Promotions' Dates until the specified Closing Date. Entries received after this date and time will not be entered into the Promotions.
  4. The instructions provided at the point of entry form part of the terms & conditions of these Promotions, and in the event of a conflict, these terms & conditions take precedence.
  5. The winner(s) will be selected from all eligible entries received on the basis of the Judging Criteria set out above. Each winner will be notified within a reasonable time after the Judging Date either by email, mail or telephone. The prize is awarded conditionally upon acceptance and if a winner is unable to be contacted after a reasonable period or if any prize is unclaimed or declined within a reasonable period, the prize shall be deemed as unclaimed or unaccepted and the next best entry may be awarded the Prize at O2's discretion.
  6. O2 will not be responsible for any inability of a prize winner to take up the specified prize.
  7. Unless otherwise expressly stated, where the prize requires attendance at a specific venue, the winner and any permitted companions will be solely responsible for travel to and from the venue and all other expenses. O2 assumes no responsibility and is not liable for any costs, charges or expenses which winners may be required to pay at any time in connection with a Prize. Any additional terms of entry specified by the venue will also apply which, in the case of events at The O2, can be viewed online at http://www.theo2.co.uk/footer/terms-conditions.html.
  8. O2 reserves the right to provide substitute prize(s) of similar value should the specified prize(s) become unavailable for reasons beyond its control. Cash or credit alternatives will not be offered. None of the prizes are transferable. Events may occasionally be cancelled for reasons outside O2's control. O2 will endeavour to promptly update any relevant information but cannot issue refunds for texts sent or calls made before this occurs (where applicable). O2 will not be liable for any change of date or venue or cancellation of any event.
  9. O2 accepts no responsibility for incorrectly completed, lost or delayed entries, notices, acceptances, tickets or other documents related to the Prize(s).
  10. In the event of fraud, abuse, and/or an error affecting the proper operation of these Promotions, including the allocation of more prizes than are available, O2 reserves the right to end or suspend any or all of the Promotions; amend these terms & conditions; declare void the notification of winner(s); and/or to allocate available prizes by conducting a simple draw from all wrongly allocated winners.
  11. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
  12. The winner(s) may be required to participate in publicity connected with these Promotions and it is a condition of entry that the winner(s) agree to their name and country of residence being made publicly available if they win.
  13. The names of the major winner(s) may be obtained by sending a signed handwritten request along with a stamped self-addressed envelope detailing your request to the Marketing Team, Telefόnica UK Limited, 260 Bath Road, Slough SL1 4DX, and marked with the name of these Promotions.
  14. Entrants' data will be collected, stored and processed for the purposes of administering and assessing these Promotions. If a prize includes tickets to an event then for the purpose of administering the ticket allocation, O2 reserves the right to exchange information and data regarding tickets and applications with third party ticket providers and/or service providers.
  15. O2's decision is final and no correspondence will be entered into.
  16. O2 reserves the right to suspend, cancel or amend the promotion and/or review and revise these terms and conditions at any time without giving prior notice and by continuing to take part in the promotion subsequent to any revision of these terms and conditions, entrants shall be deemed to have agreed to any such new or amended terms.
  17. This promotion is governed by English Law and is subject to the exclusive jurisdiction of the English courts.

App Skool Competition

Key Terms:

  • Competition Dates:

    21st November 2011 to midnight on 30th March 2012 (the “Closing Date”)

  • Entry:

    Entrants must be aged 13 to 18 but must enter as part of a school and not as individuals.

    Further information, including full details of entry will be available from the AppSkool website which can be accessed via the O2 Learn website.

    To enter the Competition, pupils must design an app that is educational and fun. On the AppSkool website there will be 4 Modules giving a step by step process on what pupils should be considering when they’re thinking about their app.

    The pupils should make a video showing off their app and upload it to an email address that will be available on the AppSkool website by the Closing Date. Videos must be no more than 10 minutes in total. Pupils should explain what their App is and how they have used the Modules.

  • Shortlisting:

    After the Closing Date, the judges will decide the 5 schools to be in the top 5. The judges will be made up of senior O2 management and a member of Golden Gekko .The judges will base their decision on a number of factors, including but not limited to, what the app can help with, the design and the cost. The 5 schools that make up the top 5 shall be the finalists (the “Finalists”).

  • Judging Criteria and Judging Date:

    The Finalists will present their submissions to the judges from 30th April 2012 and the judges will select a winner. O2 will provide up to £500 per school towards travel costs for each of the Finalists to attend the judging.

    The judges will be made up of senior O2 management and a member of Golden Gekko. The judges will judge the presentations on a number of factors, including but not limited to, what the app can help with, the design and the cost.

  • Prize:

    The Prize is free development of a single winning app by Golden Gekko. The winning school will be interviewed by magazines that Golden Gekko Ltd works with. In the event that the app is eventually sold, 50% of the profits will go to the school of the winning Entrants (at the time of their entry) and 50% will go to O2.

  1. This Competition is open to all school pupils aged 13 to 18. Pupils must enter as part of their school and not as individuals. O2 reserves the right to verify the eligibility of entrants. O2 may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and the Prize may be withheld until and unless O2 is satisfied with the verification.
  2. Only one entry per school. Entries not complying with these terms and conditions will be invalid.
  3. The Competition runs during the Competition Dates until the specified Closing Date. Entries received after this date and time will not be entered into the Competition.

    O2 will provide up to £50 per person towards travel costs to and from the concert.

    Each winner will be invited to attend the Michael Jackson Immortal World Tour show at The O2 on Tuesday Oct 16th with two friends. The winners and their friends will be hosted as VIP guests by O2 Learn in the O2 box at the Arena with priority access and hospitality throughout the gig.
